Please read these Terms of Service carefully. They set out the agreement between you and Mallow Skincare when you use this website or place an order with us. By browsing this website, creating an account, or placing an order, you agree to these terms. If you do not agree with them, please do not use the site.

1. Who we are

This website is operated by Mallow Skincare, 128 City Road, London, EC1V 2NX, United Kingdom. Throughout these terms, "we", "us" and "our" refer to Mallow Skincare, and "you" refers to the person using the site or placing an order.

You can reach us at hadeerabdelgawad283@gmail.com. We reply to emails within 2 working days, Monday to Friday.

2. Who may use this site

You must be at least 18 years old to buy from us. By placing an order you confirm that you are 18 or over and that you have the legal capacity to enter into a contract.

Our products are not intended for use by children.

3. Our products

We sell cosmetic skincare products and a cosmetic beauty device.

The device is a personal-care appliance intended for cosmetic use on the skin. It is not a medical device. It is not intended to diagnose, treat, cure or prevent any disease or medical condition, and nothing on this website should be read as medical advice. If you have any concern about your skin or your health, speak to a qualified healthcare professional before use.

Results depend on skin type, age, consistency of use and lifestyle, and will differ from person to person. Any before-and-after images, timeframes or customer comments on this site describe individual experiences and are not a promise of the results you will get.

4. Safety and who should not use the device

You are responsible for reading the instructions supplied with the device before your first use and for following them.

Do not use the device if you:

are pregnant or breastfeeding; have a pacemaker, defibrillator or any other implanted electronic device; have epilepsy; have metal implants, plates or pins in the treatment area; have an active skin infection, open wound, sunburn, eczema flare-up or unhealed cosmetic procedure in the treatment area; are undergoing treatment for cancer; or have been advised by a doctor to avoid electrical stimulation devices.

If you have had injectables, laser treatment, chemical peels or facial surgery, ask the practitioner who treated you how long to wait before using the device.

Stop using the device and contact us if you experience persistent redness, irritation, pain or any unusual reaction.

Do not use the device on the eyelids, on the front or sides of the throat, over the thyroid, or anywhere other than the areas described in the instructions. Use only the charger supplied with the device.

5. Product information and images

We do our best to display our products and their colours accurately, but we cannot guarantee that your screen shows colours exactly as they are. Packaging and formulation may be updated from time to time, so the item you receive may differ slightly in appearance from the photographs.

Ingredient lists on this site are provided in good faith and are current at the time of publishing. Always read the ingredient list on the product you receive before use, particularly if you have a known allergy.

6. Prices and payment

All prices are shown in US dollars unless stated otherwise, and include applicable taxes only where the site says so at checkout. Your bank or card issuer may apply a currency conversion or foreign transaction fee, which is outside our control.

We may change our prices at any time. The price that applies to your order is the one displayed at the moment you complete checkout. Promotional prices and discount codes apply only while the promotion is running and cannot be applied retrospectively.

Despite our best efforts, a small number of items on the site may be mispriced or described incorrectly. If we discover an error in the price or description of an item you have ordered, we will contact you before dispatch and give you the choice of continuing at the correct price or cancelling for a full refund.

Payment is taken at checkout through our payment providers. We do not store your full card details.

7. Orders

Your order is an offer to buy. A contract is formed when we send you an email confirming that your order has been dispatched, not when you receive the order confirmation email.

We may refuse or cancel an order, in whole or in part, where the item is unavailable, where there has been a pricing or description error, where we suspect fraud, or where an order appears to be placed for resale rather than personal use. If we cancel an order you have already paid for, we will refund you in full.

We may limit the quantity available to any one customer, household or address.

8. Delivery, customs and duties

Delivery times, carriers and any customs charges are covered in our Shipping Policy, which forms part of these terms.

Our products are dispatched by fulfilment partners located outside the United Kingdom. Depending on your country and the value of your order, your parcel may be subject to import duty, tax or a customs handling fee. Where these are payable, they are set by the authorities of your country, not by us. Please check your local thresholds before ordering.

Risk in the goods passes to you on delivery.

9. Returns, refunds and warranty

Returns, refunds and the device warranty are covered in full in our Refund and Returns Policy, which forms part of these terms. In summary: 14 days to change your mind on unused items, sealed skincare only, and a 1-year warranty on the device against manufacturing faults.

10. Reviews and anything you post

If you send us a review, photograph, comment or suggestion, you keep ownership of it but you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in connection with our business, including in marketing, without payment to you.

You confirm that anything you send us is your own, does not infringe anyone else's rights, and is not unlawful, abusive, defamatory or misleading. We may remove or decline to publish any submission, and we are under no obligation to keep submissions confidential.

11. Acceptable use

You agree not to use this site for any unlawful purpose, not to attempt to gain unauthorised access to it, not to interfere with its operation or security, not to scrape or copy its content for a competing purpose, and not to use it to transmit malicious code. We may suspend or terminate your access if you do.

12. Our content

All content on this site — text, product photography, graphics, logos, the name Mallow Skincare, page layout and design — is owned by us or licensed to us and is protected by copyright and trade mark law. You may view and print pages for your own personal use. You may not copy, republish, sell or use our content commercially without our written permission.

13. Third-party links

The site may link to websites we do not control. We are not responsible for their content, products or privacy practices, and a link does not mean we endorse them.

14. Availability of the site

We try to keep the site available and accurate, but we do not guarantee that it will be uninterrupted, error-free or free of harmful components. We may change, suspend or withdraw any part of the site at any time without notice.

15. Our liability to you

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under applicable product liability law, or for anything else that cannot lawfully be limited.

Subject to that, and to the extent permitted by law, we are not liable for loss of profit, loss of business, business interruption, or loss of an anticipated saving, and our total liability to you in connection with an order will not exceed the amount you paid for that order.

We are not liable for any loss or damage caused by using the device other than in accordance with its instructions and the warnings in section 4.

This section does not affect your statutory rights as a consumer.

16. Events outside our control

We are not responsible for delays or failures caused by events beyond our reasonable control, including carrier delays, customs holds, extreme weather, strikes, power or network failures, epidemics, or government restrictions. If such an event occurs, we will contact you and either extend the delivery time or, if the delay is substantial, offer you a full refund.

17. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute.

If you are a consumer resident outside England and Wales, this does not deprive you of the protection of any mandatory consumer rights that apply in your own country, and you may bring proceedings in your own country's courts where the law allows.

18. Changes to these terms

We may update these terms from time to time. The version published on this page at the moment you place an order is the version that applies to that order. Please check this page before ordering again.

19. General

If any part of these terms is found to be unenforceable, the rest continues to apply. If we do not enforce a right straight away, that does not mean we have given it up. These terms, together with our Privacy Policy, Refund and Returns Policy and Shipping Policy, form the whole agreement between us.
